Definition of Stalking in Pennsylvania





January, among other things, is National Stalking Awareness Month.  Are you aware of what Pennsylvania's stalking law states?


The crime of stalking is committed when a person:
(1) Engages in a course of conduct or repeatedly commits acts toward another person, including following the person without proper authority, under circumstances which demonstrate either an intent to place such other person in reasonable fear of bodily injury or to cause substantial emotional distress to such other person; or
(2) Engages in a course of conduct or repeatedly communicates to another person under circumstances which demonstrate or communicate either an intent to place such other person in reasonable fear of bodily injury or to cause substantial emotional distress to such other person.


Many of the words in this statute are subjective.  That is what makes stalking a difficult crime to prove to police officers and to prosecute.  However, there are some things that stalking victims can do to help supply law enforcement with relevant information.  If you believe you are being stalked, start recording the incidents, and consider reporting them to law enforcement.  The following information is especially useful.


Date, Time,  Description of Incident
Location of Incident



Witness Name (s) attached addresses and phone numbers
Police Contacted, which department, Incident or Report #
Officer's name, badge #

Transitions can provide you with a Stalking Incident and Behavior Chart in which to record this information, but any paper will do.  If you are living with the person who is stalking you, consider storing the log with a friend or family member. 

Protection from Abuse Orders can protect you from being stalked, but stalking is not included in the definition of abuse according to the PFA Act.  Contact a legal advocate with Transitions if you are being stalked and considering filing a PFA.
